Membership Regulations
 

Membership at ATENX Performance Studio does not warrant or imply membership at any other ATENX Performance Studio licensee. Any holder of this consumer credit contract is subject to all claims and defenses which the debtor could assert against the seller of goods or services obtained pursuant hereto or with the proceeds hereof. Recovery hereunder by the debtor shall not exceed amounts paid by the debtor hereunder.

 

Activation of membership: The membership is automatically activated the next day as per date of payment of membership fees unless specified by the member on sign up and date duly filed in the 'Starting date' section of the receipt & membership agreement form. The club cannot hold a membership 'Starting Date' for more than 60 days.

 

Upgradation/Renewal: Any change in membership program/upgradation has to be done within 15 days of joining. The program can be interchanged only once. A member gets a renewal package only on completion of a yearly membership. A fresh membership can be taken on completion of the earlier package. Enrollment fee does not need to be paid again.

Transfer: Transfer of a membership is permitted to a non-member i.e. to a person who has not been a member with the same branch of ATENX Performance Studio before, at a transfer fee of Rs. 2500+tax per transfer. The membership is transferable to another ATENX Performance Studio in India. A cheque with the refund amount for remaining days of membership will be made in honor of the opposite gym. The member will need to collect the cheque from the gym and hand it over to the opposite gym along with the excess difference in membership fees if applicable for selected package plus enrollment fees of Rs. 750 + tax.

Extensions/Freezing: We DO NOT freeze memberships Extensions are only given on medical basis on submission of an application and all relevant papers and on verification by our in house physiotherapists for upto 6 weeks or 9 months for pregnancies.

Cancellation/Refunds: No refunds shall be made for membership dues paid, except as follows: If by reason of death or permanent disability, the members unable to use the services or facilities of the club, he and his estate shall be relieved from the obligation of making payment for services other than that received prior to death or on the onset of disability, and that if he has prepaid any sums for services, so much of such sum as is allocable to service he has not received shall be promptly refunded to him or his representatives. The term "disability" means a condition which precludes the member from physically using the facilities, and such condition is verified by a physician & our in-house physiotherapist, and "permanent" means for more than six months. No refunds will be given for temporary disability. In case the club is closed or shut down by the management and the services cannot be transferred elsewhere, the management will refund the money on a pro-rata basis to the member for the unused period of the contract of membership.

WAIVER & RELEASE OF LIABILITY  

This membership agreement contains a waiver & release of liability and indemnity agreement in section "VI" on the reverse side of this document to which you will be bound. Do not sign this agreement before you read it. By signing below, you acknowledge receipt of a fully completed copy of this membership agreement executed by you and the club and a copy of the rules and regulations printed overleaf. You agree to be bound by the terms and conditions contained herein.

Declaration: You are aware of the risk to musculoskeletal system (sprains / strains) if exercise is not done in proper form and risk to cardio-respiratory system (dizziness, discomfort in breathing, heart attacks). You declare that you are in a physically sound state of health and are not suffering from any condition, impairment, disease, infirmity or other illness that would prevent your participation or use of equipment or machinery in this Gym. You also give consent to the trainer having to touch you during spotting or carrying out certain exercises moves.
